1. Acceptance

By downloading, installing, accessing or using the Fitenome app or website (the "Service"), you agree to be bound by these Terms & Conditions (the "Terms"), our Privacy Policy and the EULA. If you disagree, do not install or use the Service.

These Terms form a legally binding contract between you and the owner of Fitenome (identified in Privacy Policy §2).

2. Service description

Fitenome is a mobile app (iOS and Android, built on Capacitor) and a set of cloud services (Cloud Functions in europe-west1 + Firestore) for evidence-based strength training. Its key features:

  • Automatic design of a periodized plan (linear, undulating DUP, ATR or maintenance models) from your sport profile, via the generatePlan function.
  • On-demand microcycle regeneration (regenerateMicrocycle) and smart exercise swap (suggestSubstitute).
  • Macro calculation (calories, protein, carbs, fats, fiber) with the extended Mifflin-St Jeor formula and, with your consent, lean-mass anchoring.
  • Food analysis from text (parseFood) or photo / barcode (parseFoodFromImage + on-device ML Kit).
  • Daily meal plan (Premium) adapted to your microcycle (suggestMeals).
  • Tracking of completed sessions, readiness, anthropometry, PRs and internal load (Foster sRPE).
  • Cloud sync across devices when you sign up, and server-to-server verification of your Premium (verifyPremiumPurchase via RevenueCat).

Fitenome is NOT a medical device, NOT a substitute for healthcare advice, NOT a live-class platform and NOT a human coaching service. Default monthly quotas on the free plan are 2 plan generations, 5 on Premium; other function quotas may be adjusted to keep the Service sustainable.

3. User account

  • Google (OAuth).
  • Apple Sign In, including the "Hide my email" option (Apple Private Relay).
  • Email + password with mandatory email verification.
  • Guest mode with local-only data.

You are responsible for keeping your credentials confidential and for all activity under your account. Notify us at support@meetagape.com if you suspect unauthorised use.

4. Modes: guest and registered

Guest: progress stored only on the device. Reinstalling, switching phones or clearing app data wipes it.

Registered: progress synced to the cloud, accessible on any device where you sign in. The first time you register from guest mode, we offer a one-shot local-to-cloud migration.

Premium works in both modes (with a valid, verifiable store receipt). In guest mode, monthly quotas are counted per anonymous device identifier.

5. Premium subscription

5.1 Premium features

  • Plan generation with the gemini-2.5-pro model (vs gemini-2.5-flash-lite on free) and expanded monthly quota.
  • Daily meal suggestions adapted to the microcycle (suggestMeals).
  • Nutrition-label photo analysis (parseFoodFromImage).
  • On-demand regeneration of entire microcycles.
  • Smart exercise swap preserving motor pattern and relative intensity.
  • Extended anthropometry and internal-load analysis (sRPE Banister).
  • Manual selection of periodization model.

5.2 Billing and renewal

Billing is handled by App Store (iOS) or Google Play (Android). Fitenome does not process payments directly; server-to-server validation of receipts is delegated to RevenueCat Inc., acting as intermediary, which verifies Apple- and Google-signed receipts before activating your pro entitlement. Subscriptions auto-renew at the end of each period (monthly or annual) unless you cancel at least 24 hours before the end of the period. Active product identifiers (examples): fitenome_pro_yearly.

If after a refund, cancellation or billing failure your entitlement is no longer active, Fitenome reflects this in users/{uid}.premium at the next sync and restricts Premium features. Your personal data and recorded sessions are not erased for this reason.

5.3 Cancellation and refund

Cancel any time from your Apple ID or Google account settings. Refund requests follow the corresponding store's policy:

  • Apple: reportaproblem.apple.com.
  • Google Play: support.google.com.

Under EU consumer law, the consumer has 14 calendar days to withdraw, unless consumption of the digital service has started with the consumer's explicit consent and acknowledgement of the loss of the right of withdrawal.

5.4 Price changes

If we raise the subscription price, we will notify you at least 30 days in advance. Your subscription stays at the previous price until the next renewal; you may cancel to avoid the new price without penalty.

6. Use restrictions

  • No reverse engineering, decompiling or disassembling the app, except where the law mandatorily allows.
  • No automated scripts, scrapers or tools generating disproportionate load.
  • No circumventing quotas, Premium entitlements or anti-fraud mechanisms.
  • No using the Service to train machine-learning models without explicit written consent.
  • No impersonation or false identity at registration.
  • No uploading content (in notes / feedback) that is illegal, defamatory, racist, infringing or malware.
  • No reselling access nor sub-licensing.

Repeated violation may result in immediate suspension of your account without prior notice.

7. Intellectual property

The Service, its code, design, proprietary periodization models, the "Fitenome" marks, icons, documentation and any derivative work belong to the owner or its licensors and are protected by Spanish and international IP law.

We grant you a personal, non-exclusive, non-transferable, revocable and limited license to use the Service in accordance with these Terms. Any use outside that scope requires written authorisation.

Content you create (training logs, meals, notes) remains yours. You grant us a worldwide, non-exclusive, royalty-free license limited to operations required to provide the Service (storage, sync, return to client, processing by processors).

8. Generated content and swap

Plan, swap and meal proposals are generated with language models. While we apply deterministic caches and rule-based validation, we cannot guarantee clinical suitability for your particular case. You may accept, modify or ignore any suggestion.

The Service may be updated, improved or change algorithms without prior notice. We will not degrade contracted Premium features until the end of the billed period.

9. Medical and sport disclaimer

Important: Fitenome does not provide medical or physiotherapy services. The information is general and educational. Before starting an intense strength program, consult a healthcare professional, especially if you have cardiovascular disease, uncontrolled hypertension, diabetes, prior musculoskeletal injuries, pregnancy, postpartum, post-surgical recovery, an eating disorder or any condition that may worsen with physical activity.

You assume the inherent risks of sport practice. The Service owner is not liable for injuries arising from training.

10. Warranties and liability

The Service is provided "as is" and "as available". We make reasonable efforts to keep it available, accurate and secure, but we do not guarantee error-free operation, uninterrupted availability, no occasional data loss, or fitness for a particular user purpose.

To the maximum extent permitted by law, our total cumulative liability arising from the Service is limited to the amount you paid in the twelve (12) months prior to the triggering event. This limitation does not apply to damages caused by wilful misconduct or gross negligence, or to losses where the law forbids limiting liability.

11. Indemnification

You agree to hold the Service owner harmless against claims or damages arising from: (a) your breach of these Terms, (b) misuse of the Service, or (c) infringement of third-party rights.

12. Dispute resolution

For any complaint, first contact support@meetagape.com. We aim to resolve within 30 days.

Governing law: Spanish law, without prejudice to mandatory consumer protection rules applicable to consumers residing in another EEA Member State.

Jurisdiction: the courts of the consumer's domicile in Spain; in B2B relations, the courts of Madrid (Spain).

EU online dispute resolution platform: ec.europa.eu/consumers/odr.

13. Changes and termination

We may modify these Terms. For material changes we will notify by email or in-app at least 14 days in advance. If you disagree you may terminate your account before the effective date; using the Service thereafter implies acceptance of the new Terms.

You may terminate your account at any time from Profile → Delete my account. We may terminate or suspend your account immediately if you violate these Terms.

14. Miscellaneous

  • Entire agreement: these Terms, together with the Privacy Policy and the EULA, constitute the entire agreement.
  • Severability: if a clause is invalid, the rest remain in full effect.
  • No waiver: failure to enforce a right is not waiver.
  • Assignment: we may assign these Terms to a related entity or successor; you may not without consent.
  • Language: in case of discrepancy between the Spanish and English version, the Spanish version prevails.
